1. Introduction

Welcome to Telekumbu. These Terms of Service ("Terms") govern your access to and use of all products and services provided by:

By accessing our website, mobile applications, or services (collectively, the "Platform"), you agree to these Terms and our Privacy Policy.

2. Definitions

  • "Telekumbu", "we", "our", or "us" refers to Telekumbu Pty Ltd and its subsidiary AAZURE KUMBU.
  • "You" or "User" refers to the person accessing or using the Platform.
  • "Services" include all digital financial services provided by Telekumbu, including but not limited to remittance, voucher purchases, account services, and support.

3. Eligibility

You must be:

  • At least 18 years old (or the age of majority in your jurisdiction), and
  • Capable of entering into a binding contract.

If you are using the Platform on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

4. User Obligations

You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your login credentials.
  • Use the Platform only for lawful purposes.
  • Not attempt to interfere with our systems or compromise other users' accounts.

5. Services and Availability

Telekumbu offers cross-border financial services focused on users sending funds or purchasing digital vouchers. Services are provided primarily in:

  • Australia via Telekumbu Pty Ltd.
  • Angola via AAZURE KUMBU – COMÉRCIO E SERVIÇOS, LDA.

Service availability may vary by jurisdiction and regulatory constraints. We reserve the right to modify or suspend services without notice for maintenance, upgrades, or legal compliance.

6. Fees and Exchange Rates

Service fees, foreign exchange rates, and transaction limits will be clearly disclosed at the time of each transaction. By proceeding with a transaction, you accept the applicable rates and charges.

Telekumbu reserves the right to adjust pricing at any time. Updated pricing will apply to future transactions only.

7. Privacy and Data Sharing

Your data is handled according to our Privacy Policy. In summary:

  • Telekumbu collects and processes your personal information to provide services, verify identity, prevent fraud, and meet legal obligations.
  • Personal information may be shared with our Angolan subsidiary (AAZURE KUMBU – COMÉRCIO E SERVIÇOS, LDA) strictly for service delivery and regulatory compliance.
  • Your information is safeguarded using Australian Privacy Principles (APPs) as a global standard, even when handled abroad.

8. Compliance and Restrictions

You agree not to use our services for:

  • Money laundering, terrorist financing, or fraudulent purposes
  • Transactions involving sanctioned individuals, countries, or entities
  • Activities in violation of Australian, Angolan, or international law

Telekumbu reserves the right to reject, reverse, or freeze any transaction at its discretion if illegal activity is suspected.

9. Account Suspension or Termination

We may suspend or terminate your account if you:

  • Breach these Terms
  • Provide false information
  • Violate laws or misuse the Platform
  • Engage in suspicious or unauthorized activity

Where practical, we will notify you prior to termination or explain the reasons afterward.

10. Intellectual Property

All content on the Platform including logos, text, graphics, software, and design belong to Telekumbu Pty Ltd or its licensors. You may not reproduce, copy, or exploit any part of the Platform without our written permission.

11. Disclaimers

Our services are provided "as is" and "as available." We do not guarantee:

  • That the services will be uninterrupted or error-free
  • That the Platform is free of malware or vulnerabilities
  • That exchange rates or third-party partner behavior will remain fixed or predictable

We disclaim all warranties to the extent permitted by law.

12. Limitation of Liability

To the extent permitted by law, Telekumbu and its affiliates will not be liable for:

  • Indirect or consequential damages
  • Loss of income, revenue, or data
  • Unauthorized access to your account if caused by your own negligence
  • Any failure to perform obligations due to events beyond our control (e.g., natural disasters, regulatory actions)

13. Dispute Resolution

If unresolved:

  • Disputes related to services accessed in Australia will be governed by the laws of Western Australia.
  • Disputes related to services accessed in Angola will be governed by Angolan law.

In either case, you agree to attempt good-faith mediation before pursuing arbitration or legal action.

14. Amendments to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Continued use of our services indicates your acceptance of the updated policy.

15. Force Majeure

We are not liable for any failure or delay in performance of our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, war, civil unrest, or regulatory changes.

16. Indemnity

You agree to indemnify and hold harmless Telekumbu Pty Ltd and AAZURE KUMBU – COMÉRCIO E SERVIÇOS, LDA, including their directors, employees, and affiliates, from any claims, liabilities, damages, or expenses (including legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any applicable law
  • Your misuse of the Platform or Services

17. Class Action Waiver and Jurisdiction

All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

  • For Australian-based services, the exclusive jurisdiction will be the courts of Western Australia.
  • For Angola-based services, the exclusive jurisdiction will be the courts in Luanda, Angola.

18. No Financial Advice

Nothing on the Platform constitutes financial, investment, or legal advice. We do not guarantee any particular financial outcome. Users should consult licensed professionals before making financial decisions.

19. Right to Refuse Service

We reserve the right to refuse service, suspend transactions, or terminate accounts at our sole discretion, including without prior notice, for any reason permitted by law.

20. Arbitration Clause

Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by binding arbitration.

  • If the dispute arises in connection with services rendered by Telekumbu Pty Ltd (Australia), the arbitration shall be conducted in Perth, Western Australia, in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).
  • If the dispute arises in connection with services rendered by AAZURE KUMBU (Angola), the arbitration shall be conducted in Luanda, Angola, in accordance with applicable Angolan arbitration rules.
